When is it needed?

When does a commercial premises need a habitation certificate?

Change of use to residential

When converting a commercial space into a residential property, a first occupation certificate is required certifying the premises meets the minimum habitability conditions under Decree 145/1997.

Mixed-use buildings

Some mixed-use buildings have residential units on upper floors above commercial ground floors. Each residential unit needs its own habitation certificate.

Regularisation of irregular premises

Premises historically used as residential without the appropriate certificate. We analyse the situation and determine the right procedure (renewal, first occupation or carencia).

What's the difference with an activity licence?

A habitation certificate (issued by the Consell Insular) certifies residential habitability. A business activity licence (issued by the local council) authorises a specific commercial activity. They are completely different documents.

Tourist rental licence (ETV)

If you plan to use a commercial premises that has been converted to residential for tourist rental, you will need both the habitation certificate and the ETV licence from the Balearic Government.

Not always. A habitation certificate is required when the premises is used or will be used for residential purposes — either as a dwelling or as tourist accommodation. A purely commercial space (shop, office, warehouse) typically requires a different type of licence, not a habitation certificate.
