The cédula por carencia applies when a property has never had a certificate and it can be shown that the building was completed before 1 March 1987, that there is no planning infringement, and that no works requiring a first-occupation certificate have been carried out since that date. If you have the old certificate (even if expired), the right option is renewal.
The cédula por carencia is the specific procedure of the Consell Insular de Mallorca for properties that have never had a habitation certificate and meet three conditions: the building was completed before 1 March 1987, there is no planning infringement, and no works requiring a first-occupation certificate have been carried out since that date. If you have the old certificate (even expired), a renewal is the right — and simpler — option.
This is the main requirement. It must be documented that construction was completed before that date — via title deeds, land registry, old utility bills or equivalent documents.
The property must not have an open planning enforcement file or unresolved infringement. We verify the planning status before starting the process.
No works or actions requiring a first-occupation certificate (new build, full renovation, change of use) can have been carried out since the construction date. Otherwise, a different process would apply.
Properties built before the certificate was compulsory in the Balearic Islands, which never applied for one and now need to sell, rent or regularise.
Owners who no longer have the certificate and for which the Consell Insular de Mallorca has no record. We check the Consell archive first.
When settling an estate involving an old property, it is discovered that it never had a certificate. Common in Mallorca with properties inherited across generations.
Properties historically sold without a certificate that now need to regularise their position for a new sale or tourist rental.
The Consell Insular de Mallorca accepts alternative documentation to prove the age and residential use of the property when no prior certificate exists. These are the most commonly used documents.
Electricity or water bills more than 10 years old in the name of the owner or a previous tenant, proving historical residential use of the property.
Municipal certificate confirming the age of the building, planning legality and residential use. We request this from the relevant council on your behalf.
The land registry extract can confirm the age of the property and successive transfers. Useful for demonstrating continuous residential use.
Spanish Cadastre data, including the construction year and cadastral use, help support the age of the property before the Consell Insular de Mallorca.
Sale, inheritance or gift deeds from previous owners showing the historical residential use of the property and its succession.
In special cases, photographs or documentation proving the state of the property and its residential use over time.
