What happens when the habitation certificate expires?
When a habitation certificate expires, the property is technically no longer covered by a valid document. In practice this means:
- Cannot sell — the notary requires a valid certificate to formalise the deed of sale.
- Cannot legally rent — both long-term and tourist rentals require a valid certificate.
- Cannot connect utilities — electricity, water and gas companies may refuse to connect or change the account holder.
- Cannot apply for a tourist rental licence (ETV) — or renew one that is already held.
There is no penalty for failing to renew on time. The certificate simply becomes invalid, and you cannot carry out any of the above until a new one is obtained.
Renewal vs. cédula por carencia: which do I need?
This is the most common source of confusion. The key question is: did the property ever have a certificate?
- Renewal — the property had a prior certificate (even if it expired years ago). This is the simpler, cheaper option. From €189+VAT.
- Cédula por carencia — the property has never had a certificate and cannot be found in the Consell archive. More complex process. From €299+VAT.
Step-by-step: how to renew an expired habitation certificate

What if the property doesn't meet the requirements?
If during the technical inspection we find that the property does not meet one or more minimum requirements of Decree 145/1997, we inform you of the specific issues before submitting anything to the Consell. How long does the renewal take?
