Expired habitation certificate: what happens and how to renew it in Mallorca

Habitation certificates in Mallorca expire every 10 years. Many property owners — especially those who have inherited a property or not used it for years — discover that their certificate has lapsed precisely when they need it most: for a sale, a rental or to connect utilities. This article explains the consequences of having an expired certificate and the complete renewal process.

What happens when the habitation certificate expires?

When a habitation certificate expires, the property is technically no longer covered by a valid document. In practice this means:

  • Cannot sell — the notary requires a valid certificate to formalise the deed of sale.
  • Cannot legally rent — both long-term and tourist rentals require a valid certificate.
  • Cannot connect utilities — electricity, water and gas companies may refuse to connect or change the account holder.
  • Cannot apply for a tourist rental licence (ETV) — or renew one that is already held.

There is no penalty for failing to renew on time. The certificate simply becomes invalid, and you cannot carry out any of the above until a new one is obtained.

Renewal vs. cédula por carencia: which do I need?

This is the most common source of confusion. The key question is: did the property ever have a certificate?

  • Renewal — the property had a prior certificate (even if it expired years ago). This is the simpler, cheaper option. From €189+VAT.
  • Cédula por carencia — the property has never had a certificate and cannot be found in the Consell archive. More complex process. From €299+VAT.
Important: Even if you don't have the old certificate physically, it may still be on record at the Consell Insular de Mallorca archive. We check the archive before advising you which procedure applies.

Step-by-step: how to renew an expired habitation certificate

  1. Contact us — describe your case by form, WhatsApp or phone. We'll advise on the right procedure and provide a fixed quote within 24 hours.
  2. Technical inspection — our technical architect visits the property and checks it meets the minimum habitability requirements of Decree 145/1997 (floor areas, ceiling heights, ventilation, installations). Duration: ~30 minutes. You don't need to be present.
  3. Technical certificate — we issue the signed technical habitability certificate.
  4. Submission to the Consell — we submit the full application to the Consell Insular de Mallorca and pay the administrative fees (included in your quote).
  5. Official certificate delivery — 2 to 6 weeks after submission, the Consell issues the official certificate. We forward it to you digitally.

What if the property doesn't meet the requirements?

If during the technical inspection we find that the property does not meet one or more minimum requirements of Decree 145/1997, we inform you of the specific issues before submitting anything to the Consell. In many cases the remedies are straightforward — for example, installing or improving ventilation. We advise on the most practical and cost-effective solutions.

How long does the renewal take?

Our part — from first contact to submission — is typically resolved within a week. The Consell Insular de Mallorca then takes between 2 and 6 weeks to issue the official resolution, depending on their workload. In total, the process usually completes in 3 to 7 weeks.

FAQ — expired certificates

My certificate expired 15 years ago. Can I still renew it? +
Yes. There is no time limit on renewal once a certificate has expired. As long as a prior certificate exists (on file at the Consell or in your possession), the renewal procedure applies, regardless of how long ago it expired.
I don't have the physical certificate but know one was issued. What do I do? +
Contact us. We check the Consell Insular de Mallorca archive first. In many cases the prior certificate is on record, even if you have never seen it. If it is found, renewal is the right procedure. If not, we advise on the carencia process.
Can I sell my property while the renewal is in progress? +
The notary requires the official certificate, not just proof that an application has been submitted. This means you generally need the certificate before completing the sale. If you have a deadline coming up, contact us immediately so we can prioritise your file.
