What is the habitation certificate (cédula de habitabilidad) and what is it for in Mallorca?

The habitation certificate (cédula de habitabilidad) in Mallorca is the official administrative document issued by the Consell Insular de Mallorca certifying that a residential property meets the minimum habitability requirements established by Decree 145/1997 of the Balearic Government. Without this document, certain legal and administrative transactions cannot be completed. In the Balearic Islands, the habitation certificate is mandatory and its processing falls to the Consell Insular de Mallorca — not the local council. This is significant because the timescales, documentation and procedure differ from other regions of Spain. This guide explains precisely what it is, what it is for, which regulations govern it and the difference between the technical certificate issued by the architect and the official certificate issued by the administration.

What exactly does the habitation certificate certify?

The habitation certificate certifies that a property meets the minimum habitability requirements defined in Decree 145/1997, of 11 July, of the Government of the Balearic Islands. These requirements include:

  • Minimum habitable floor area according to the number of occupants
  • Minimum ceiling height (2.50 m in living areas, 2.20 m in bathrooms and kitchens)
  • Natural or indirect ventilation and light
  • Functioning running water and electricity installations
  • Wastewater drainage systems

The document certifies that the property is fit for residential use in its current condition. It does not assess the general state of conservation, nor whether the property has structural problems, damp or deteriorated installations. Those aspects belong to other technical inspections.

Regulatory framework: Decree 145/1997 in the Balearic Islands

The legislation governing habitation certificates in the Balearic Islands is Decree 145/1997, of 11 July, of the Balearic Government, subsequently developed by instructions from the Consell Insular de Mallorca. This regulation establishes the minimum parameters a property must meet to obtain or renew the certificate, and distinguishes between first occupation (for new builds or full renovations) and renewal (for properties with a prior certificate).

Unlike other regions of Spain — where competence may rest with local councils — in Mallorca the entire process is handled by the Consell Insular de Mallorca, with its own timescales and administrative fees. The qualified professional (technical architect) acts as the licensed professional authorised to issue the prior technical certificate confirming compliance with the requirements.

What is the habitation certificate used for? Legal requirements in Mallorca

Property purchase

The notary requires a valid habitation certificate to formalise the deed of sale of a residential property in Mallorca. Without a valid certificate, the deed cannot be signed under standard conditions, which may block or invalidate the transaction.

Residential and tourist rental (ETV)

To let a property on a long-term basis, Balearic law requires the property to have a valid habitation certificate. In the case of tourist rental regulated through Estancias Turísticas en Viviendas (ETV), the certificate is an essential requirement to obtain and maintain the licence issued by the Balearic Government.

Connecting utilities

Water, electricity, gas and telecoms companies require the habitation certificate to activate or transfer utility contracts at a property. Without a valid certificate, the application may be refused or subject to conditions.

Address registration (empadronamiento)

The municipal register is the official record of residents. In Mallorca, many councils request the habitation certificate as proof of habitual address to process a registration application.

Difference between the technical certificate and the official certificate

The process of obtaining a habitation certificate consists of two distinct phases.

In the first phase, a qualified professional (technical architect) visits the property, verifies that it meets the parameters of Decree 145/1997 and issues a signed technical certificate. This document certifies technical compliance but is not the official certificate.

In the second phase, that technical certificate is submitted to the Consell Insular de Mallorca along with the rest of the required documentation. Once the application has been processed and the administrative fees paid, the Consell issues the official habitation certificate. It is this second document — not the technical certificate — that has legal and administrative validity.

Important: The technical certificate is signed by the technical architect. The official certificate is issued by the Consell Insular de Mallorca. They are two separate documents and both are necessary in the process.

Who can apply for a habitation certificate in Mallorca?

The application must be made by a qualified licensed professional — in practice, a technical architect registered with the COAIB (Col·legi Oficial d'Arquitectes Tècnics de Illes Balears). The property owner cannot apply directly without going through a professional, since the prior certificate must be signed by a licensed practitioner.

At CertiHabit, the technical architect handles the entire process: technical inspection, technical certificate, submission to the Consell Insular de Mallorca and payment of administrative fees. The client simply provides access to the property and initial documentation.

Frequently asked questions

Is the habitation certificate mandatory for all properties in Mallorca? +
The habitation certificate is mandatory for any legal or administrative transaction involving the residential use of a property: purchase, rental, utilities or address registration. Properties that are not going to undertake any of these transactions in the short term do not have an immediate obligation to apply, but it is advisable to keep it valid.
How long does the Consell Insular take to issue the certificate? +
Our part of the process — technical inspection, certificate and submission of the application — is resolved in under a week. The Consell Insular de Mallorca typically takes 2 to 6 weeks to issue the resolution, depending on their workload at the time.
Is the habitation certificate the same as the first occupation licence? +
Not exactly. The first occupation licence is granted by the local council and certifies that the construction has been carried out in accordance with the building licence. The habitation certificate is issued by the Consell Insular de Mallorca and certifies that the property meets the minimum habitability requirements. They are different documents, although in the case of new builds they are often processed in a related sequence.
What happens if I sell a property without a valid habitation certificate? +
The notary requires a valid certificate to formalise the deed of sale under standard conditions. If the certificate has expired or does not exist, the sale may not proceed, may be delayed or may require special conditions. The normal course of action is to arrange renewal before the completion date.
Do garages and storage rooms need a habitation certificate? +
No. The habitation certificate applies to dwellings, residential premises and buildings intended for residential use. Garages, storage rooms and purely commercial premises are subject to different regulations.
