What exactly does the habitation certificate certify?
The habitation certificate certifies that a property meets the minimum habitability requirements defined in Decree 145/1997, of 11 July, of the Government of the Balearic Islands. These requirements include:
- Minimum habitable floor area according to the number of occupants
- Minimum ceiling height (2.50 m in living areas, 2.20 m in bathrooms and kitchens)
- Natural or indirect ventilation and light
- Functioning running water and electricity installations
- Wastewater drainage systems
The document certifies that the property is fit for residential use in its current condition. It does not assess the general state of conservation, nor whether the property has structural problems, damp or deteriorated installations. Those aspects belong to other technical inspections.

The legislation governing habitation certificates in the Balearic Islands is Decree 145/1997, of 11 July, of the Balearic Government, subsequently developed by instructions from the Consell Insular de Mallorca. This regulation establishes the minimum parameters a property must meet to obtain or renew the certificate, and distinguishes between first occupation (for new builds or full renovations) and renewal (for properties with a prior certificate).
Unlike other regions of Spain — where competence may rest with local councils — in Mallorca the entire process is handled by the Consell Insular de Mallorca, with its own timescales and administrative fees. The qualified professional (technical architect) acts as the licensed professional authorised to issue the prior technical certificate confirming compliance with the requirements.
What is the habitation certificate used for? Legal requirements in Mallorca
Property purchase
The notary requires a valid habitation certificate to formalise the deed of sale of a residential property in Mallorca. Without a valid certificate, the deed cannot be signed under standard conditions, which may block or invalidate the transaction.
Residential and tourist rental (ETV)
To let a property on a long-term basis, Balearic law requires the property to have a valid habitation certificate. In the case of tourist rental regulated through Estancias Turísticas en Viviendas (ETV), the certificate is an essential requirement to obtain and maintain the licence issued by the Balearic Government.
Connecting utilities
Water, electricity, gas and telecoms companies require the habitation certificate to activate or transfer utility contracts at a property. Without a valid certificate, the application may be refused or subject to conditions.
Address registration (empadronamiento)
The municipal register is the official record of residents. In Mallorca, many councils request the habitation certificate as proof of habitual address to process a registration application.
Difference between the technical certificate and the official certificate
The process of obtaining a habitation certificate consists of two distinct phases.
In the first phase, a qualified professional (technical architect) visits the property, verifies that it meets the parameters of Decree 145/1997 and issues a signed technical certificate. This document certifies technical compliance but is not the official certificate.
In the second phase, that technical certificate is submitted to the Consell Insular de Mallorca along with the rest of the required documentation. Once the application has been processed and the administrative fees paid, the Consell issues the official habitation certificate. It is this second document — not the technical certificate — that has legal and administrative validity.
Who can apply for a habitation certificate in Mallorca?
The application must be made by a qualified licensed professional — in practice, a technical architect registered with the COAIB (Col·legi Oficial d'Arquitectes Tècnics de Illes Balears). The property owner cannot apply directly without going through a professional, since the prior certificate must be signed by a licensed practitioner.
