Commercial premises (locales comerciales) can need a habitation certificate in Mallorca under certain circumstances — primarily when they are being converted to residential use or when they have historically been used as residential without the appropriate documentation. When does a commercial premises need a habitation certificate?

A commercial premises requires a habitation certificate in Mallorca in the following situations:

  • Change of use from commercial to residential: When a shop, office or warehouse is converted into a flat or dwelling, a first occupation certificate is required.
  • Mixed-use buildings: Upper-floor residential units in mixed-use buildings need their own habitation certificate, regardless of the commercial use on the ground floor.
  • Historic residential use without documentation: Spaces that have been used as dwellings without a certificate — common in older Spanish towns — need to regularise their situation.
  • Tourist rental of converted spaces: A commercial space converted to residential and rented to tourists needs both the habitation certificate and the ETV licence.

Habitation certificate vs. business activity licence

These are completely different documents that often cause confusion:

  • Habitation certificate (cédula de habitabilidad): Issued by the Consell Insular de Mallorca. Certifies that a space meets minimum habitability requirements for residential use.
  • Business activity licence (licencia de actividad): Issued by the local council (ayuntamiento). Authorises a specific commercial activity at the premises.

A commercial premises operating as a shop needs a business activity licence, not a habitation certificate. A commercial space converted to a flat needs a habitation certificate, not just a business activity licence.

Which type of habitation certificate applies to commercial premises?

  • If the space has been converted from commercial to residential and the works were completed recently: First occupation certificate.
  • If the space has historically been used as residential without documentation, and construction pre-dates 1987: Cédula por carencia.
  • If the space previously had a habitation certificate (even as a dwelling): Renewal.
