Problem 1: not knowing which type of certificate you need
Solution: Contact a specialist. The distinction between renewal, carencia and first occupation depends on the specific history of the property — not on its age alone. A professional who knows the Consell archive and the Balearic regulations can advise you in minutes.
Problem 2: the certificate expired years ago
Solution: Renewal is available regardless of how long ago the certificate expired. As long as a prior certificate exists on the Consell archive (which we check), renewal is the right procedure. No penalty for the delay — just apply when you need it.
Problem 3: no prior certificate and no documents
Solution: The cédula por carencia procedure allows you to obtain a certificate using alternative documentation. We research what exists — land registry, cadastral data, council records — and build the strongest possible documentation set for your case. In 10 years, we have resolved cases where the owner had virtually no documents at all.
Problem 4: property doesn't meet the minimum requirements
Solution: If during the inspection the property doesn't meet a requirement (typically ceiling height, floor area or ventilation), we identify the specific issue and advise on the most cost-effective remedy. We never submit a file we believe will be rejected. Fixes are often simpler than expected.
Problem 5: rural land (suelo rústico) complications
Solution: Rural land properties have additional documentation requirements, particularly for carencia (urban planning certificate from the local council). We know exactly what each municipality requires and in many cases obtain these certificates on your behalf.
Problem 6: the sale is in 4 weeks and the certificate just expired
Solution: Contact us immediately. We can prioritise your file to submit to the Consell within days. The Consell itself takes 2–6 weeks, so even in urgent situations we can sometimes meet tight deadlines. The sooner you contact us, the more options we have.
Problem 7: inheriting a property with no certificate
Solution: Inherited properties without a habitation certificate are very common in Mallorca. If the property pre-dates 1987 and has no planning infringements, the carencia procedure applies. We assess the specific case and advise on the documentation needed.
Problem 8: the notary is asking for the certificate and it doesn't exist
Solution: Explain the situation to the notary and start the process immediately. In some cases, particularly where the certificate is being applied for during a sale, the notary may allow the sale to proceed with specific conditions attached. Contact us and we'll advise on the fastest route.
Problem 9: previously rejected application
Solution: If another professional's application was rejected by the Consell, we assess the reasons for rejection and advise on whether and how it can be resubmitted. In our experience, rejections are almost always avoidable with the right preparation.

Solution: The Consell Insular de Mallorca resolution time is outside our control, but we submit applications promptly and correctly to avoid any administrative delays on our end. We also follow up with the Consell on your behalf and keep you informed throughout.
