Why might a property never have had a certificate?
The habitation certificate (cédula de habitabilidad) in the Balearic Islands was not always required. Many properties built before the 1970s and 1980s simply didn't go through the certification process at the time of construction. Additionally, some properties passed from owner to owner without the issue ever being raised, meaning generations of family members may have lived there without a certificate ever being obtained.
The most common situations where a property has no certificate are:
- Old village houses (particularly in historic centres like Palma's old town, Pollença, Sóller)
- Rural fincas and country properties
- Inherited properties that have been in the family for decades
- Properties converted from agricultural or commercial use to residential use long ago
What is the cédula por carencia?
The cédula por carencia is the specific procedure the Consell Insular de Mallorca provides for properties that have never had a habitation certificate. Rather than a prior certificate, you provide alternative documentation to prove the property's age and historical residential use.
The key conditions for the carencia procedure are:
- The property was completed before 1 March 1987
- There is no planning infringement on record
- No works requiring a first-occupation certificate have been carried out since then
If the property was built after 1987 or has had major works, the first occupation certificate procedure applies instead.
What alternative documents are accepted?
Common documents used to prove age and historical residential use:
- Old electricity or water bills (pre-1987)
- Title deeds showing historical ownership
- Land registry extract
- Cadastral data (año de construcción)
- Urban planning certificate from the local council
- Historical photographs (in exceptional cases)
